BC Brands Privacy Policy

1. Who we are

"BC Brands" is a collection of organisations and projects operated by the same team. We primarily provide services for our clients, although we also collect some personal information ourselves. "we" and "us" refer to BC Brands.

Some projects, sites and services within BC Brands may have their own privacy policies, which act as an extension to the BC Brands Privacy Policies. These additional policies detail further information that may be collected, stored and used by these services. Any additional policies can be found on the respective parts of the BC Brands website.

"BC Brands" consists of 4 primary service providers, each of which may have different policies that may be applicable as well as this policy. See below for further information.

BC Accounts (BCA) - If you have a BC Brands Account, you will be subject to the Accounts Terms & Conditions.

BC Host (BCH) - If you make use of the BC Host Platform, you will be subject to the BC Host Terms of Use and the BC Host Privacy Policy.

BC Brands Software Centre (BCSC) - If you use any software developed by BC Brands, you will be subject to the BC Brands Software Centre Terms & Conditions as well as any Software Licences you may have.

BC Website Design (BCWD) - If your website was designed by BC Website Design, then your data will be subject to the BC Website Design Privacy Policy.

2. Information we collect

When you sign up for a BC Brands account, you provide us with your name, email address, website information, organisation information and any other information provided during your account setup. This is stored in our database. This information is stored for the purposes of providing our services.

We receive, collect and store any information you enter on our website or provide us in any way. We also collect personally identifiable information (including name, email, communications), comments, feedback, product reviews, recommendations, and personal profile. We may also store any information provided by phone or by email. Emails will be stored through our email mail clients, Google Workplace and BC Emails. This information is collected to provide our services

In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; computer and connection information. This is used for spam prevention.

OneSignal, our push notification provider, also collects the date you subscribed, the last active session, whether or not you are still subscribed, your browser, your device operating system, number of active sessions, country, language and a non-identifiable user ID. OneSignal also collects analytical data such as how many users clicked on a notification.

We also collect general non-identifiable information such as likes and follows on various Social Media platforms that we use. Social Media platforms may also store reviews, comments and other information provided. If you came from Google Search, Google Search Console will have recorded anonymous information about how many people saw our website in search results and whether they visited our website. We use Google Search Console for analytics purposes, which may collect session information, device type, operating system and more.

We also collect and store any information that is created through the use of our services.

3. How we collect the information

When you type in your information into our contact forms, websites, via email and in any other communications with you, we collect personal information you give us such as your name, email address and any information or materials you share with us. We assume that you agree to the collection of your personal information and that it will be used for the specific reasons stated to provide our services to you. We also collect the information listed above when you: fill out contact forms, email us, phone us, enter a Chatbot conversation, subscribe to push notifications, use our website, view our website on Google Search, interact with posts or profiles on Social Media and other methods you may use to contact us.

4. How we store, use, share and disclose your personal information

Our website is hosted on our BC Host platform. Your data may be stored through BC Host’s databases and systems. Your data may be processed on our provider’s servers, who securely store our data. Most BC Brands services are delivered through Namecheap, Ionos and Azure servers. Our providers may have access to your data for the sole purpose of troubleshooting and providing their services to BC Brands. Our providers have implemented and will maintain security systems implemented across their network, as part of their agreement with us.

Non-identifiable analytics data is also stored through Google Search Console analytics data being anonymous, we never share this information and only use it to understand the usage and improve our site.

Information from the Chatbot and contact forms may also be stored in our systems. Again, we will never share this information and will only use this to communicate with you as defined below. OneSignal stores the information listed above which BC Brands only uses to provide updates via push notifications and understand notification usage.

Social Media platforms may store analytics and other information indefinitely. We may use Social Media information such as comments, feedback and review to contact you and improve your experience. Any analytics data may be stored indefinitely. Note that these 3rd party providers will have their own policies regarding how they collect and store information which are not covered by the BC Brands Policy.

Emails sent to BC Website Design will be stored by our mail provider, Google Workplace (Google) and may also be subject to their privacy policy. Emails sent to, or via, other BC Brands will be stored on the BC Host platform. Any other communications may be stored through the communication channel.

When strictly necessary, we may provide information regarding you, your site, or your communications with us, to related entities involved in hosting and providing the services used on your site.

5. hCaptcha

We use the hCaptcha security service (hereinafter "hCaptcha") on our website. This service is provided by Intuition Machines, Inc., a Delaware US Corporation ("IMI"). hCaptcha is used to check whether user actions on our online service (such as submitting a login or contact form) meet our security requirements. To do this, hCaptcha analyzes the behavior of the website or mobile app visitor based on various characteristics. This analysis starts automatically as soon as the website or mobile app visitor enters a part of the website or app with hCaptcha enabled. For the analysis, hCaptcha evaluates various information (e.g. IP address, how long the visitor has been on the website or app, or mouse movements made by the user). The data collected during the analysis will be forwarded to IMI. hCaptcha analysis in the "invisible mode" may take place completely in the background. Website or app visitors are not advised that such an analysis is taking place if the user is not shown a challenge. Data processing is based on Art. 6(1)(b) of the GDPR: the processing of personal data is necessary for the performance of a contract to which the website visitor is party (for example, the website terms) or in order to take steps at the request of the website visitor prior to entering into a contract. Our online service (including our website, mobile apps, and any other apps or other forms of access offered by us) needs to ensure that it is interacting with a human, not a bot, and that activities performed by the user are not related to fraud or abuse. In addition, processing may also be based on Art. 6(1)(f) of the GDPR: our online service has a legitimate interest in protecting the service from abusive automated crawling, spam, and other forms of abuse that can harm our service or other users of our service. IMI acts as a "data processor" acting on behalf of its customers as defined under the GDPR, and a "service provider" for the purposes of the California Consumer Privacy Act (CCPA). 6. Information we have access to

BC Brands provides services for our clients, their websites, networks and services. This may mean that we sometimes have access to our client’s own customer information, and this may be stored in our systems and databases. This data is encrypted where possible, and we take all reasonable measures to ensure there is no unauthorised access to this information. We only access our client’s customer information when absolutely necessary for providing essential maintenance to client websites and services. We do not store or transfer this information outside of the services and technologies used by our clients, as detailed in their own policies, other than for creating backups. We do not share any information with anyone other than our clients. We do not contact any of our client’s customers directly and any communications that appear to have come from us should be disregarded as spam.

7. Communications

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our any agreement we may have with you. For these purposes, we may contact you via email, telephone, text messages, Chatbot messages and postal mail.

All emails from BC Brands will come from an @bcwd.site (or subdomains of bcwd.site e.g. @host.bcwd.site) or @bcwebsitedesign.co.uk address. Any correspondence from any other emails should be treated as spam.

8. Use of cookies and other tracking technologies

BC Brands uses Strictly Necessary, Functional, Performance and Analytics Cookies.

BC Emails - Strictly Necessary, Functional, Performance - Cookies may be used for the purposes of sending and receiving emails.

OneSignal - Functional, Analytics - OneSignal may use cookies for the purposes of sending push notifications, and for analytics purposes.

Status Page - Functional - We use Status Page to provide updates about our services to clients. Status Page may use cookies to enable them to deliver their services.

BC Accounts - Strictly Necessary - Our Accounts system uses cookies to enable us to correctly authenticate our clients.

9. How long do we retain your information?

Any information you provide us to allow us to provide our services to you is stored as long as you use our services, or as long as required to deliver our services.

Your name, business name, website address, comments, feedbacks, reviews, recommendations and any photos or content of your website may be stored indefinitely for display purposes on our website.

10. How you will be able to withdraw your consent

If you don’t want us to process your data anymore, please contact us on gdpr@bcwd.site. If at any time you confirm that you do not wish us to process your data, your details will be removed as soon as possible. We aim to do this within two weeks but note that this may not be possible depending on how long third parties take to respond.

11. Ability to update the Privacy Policy

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it. We will not notify you of minor changes to this policy.
